Terms and Conditions for Customers

GoRush is operated by APDV PORTAL L.L.C, Trade Licence No. 1110778, Commercial Register No. 2933100, licensed in Dubai for the activity “Portal”. GoRush provides a digital marketplace, booking, calendar, payment-facilitation and customer-support environment through which independent service providers can offer services to customers.

Unless a listing expressly states otherwise, the underlying activity or service is supplied and performed by the service provider identified in the listing. GoRush facilitates discovery, booking, communications and payment and may assist with complaints and refunds. The provider remains responsible for holding the licences, permits, approvals, qualified personnel, equipment and insurance required for its service and for performing the service safely and in accordance with the listing and applicable law.

Nothing in these Terms excludes any responsibility that cannot lawfully be excluded, including mandatory consumer rights or liability arising from GoRush’s own acts or omissions.

• You must be at least 18 years old to create an account and enter into a booking unless applicable law permits otherwise.
• You must provide accurate, current information and keep account credentials secure.
• You are responsible for activity conducted through your account unless caused by a platform security failure for which GoRush is legally responsible.
• A booked activity may impose additional age, health, height/weight, driving-licence, experience, clothing, equipment, waiver or guardian requirements. These must be reviewed before booking.

A provider listing should describe the service, inclusions/exclusions, location, duration, available dates/times, price, material restrictions and safety/eligibility conditions. A booking becomes confirmed when the platform displays or sends a booking confirmation after the required payment or booking step is successfully completed.

Obvious pricing, availability or technical errors may be corrected before performance. If a confirmed booking is materially affected by an error attributable to GoRush or the provider, the customer will be offered an appropriate remedy, which may include correction, rebooking or refund as required by applicable law.

Prices are shown in AED unless otherwise stated and should include applicable taxes where required. Depending on the listing, the customer may pay: (a) the full booking value online; or (b) a booking deposit/partial amount online with the balance payable directly to the provider as stated at checkout.

Online payments may be processed by Mamo or another authorised payment service provider. The customer authorises the payment processor and GoRush to process the transaction information necessary to complete the booking, administer refunds and handle payment disputes. Payment-card processing may also be governed by the processor’s terms.

The cancellation conditions applicable to a booking must be displayed before checkout and form part of the booking contract. Unless the listing clearly states another lawful cancellation rule, the GoRush default policy is a full refund of the prepaid amount when the customer cancels at least 24 hours before the scheduled service time; cancellations made less than 24 hours before the service are ordinarily non-refundable.

If a service is not provided, is materially different from the confirmed booking, or is only partially delivered, the customer may request an appropriate remedy. Depending on the circumstances and applicable law, this may include full refund, proportionate refund, re-performance or rebooking. No-show, late arrival, failure to meet disclosed eligibility requirements, or interruption caused by the customer may reduce or eliminate refund eligibility where lawful.

Approved refunds are returned to the original payment method where practicable. Processing time depends on the payment provider and banking network; GoRush will initiate approved refunds without unreasonable delay.

Adventure and outdoor activities may be affected by weather, sea conditions, mechanical issues, government restrictions or safety concerns. A provider may delay, reschedule, modify or cancel an activity where reasonably necessary for safety or legal compliance. If the booked service cannot be supplied, the customer will be offered the remedy required by the applicable booking terms and mandatory consumer law.

• Follow lawful safety instructions, briefings and equipment requirements issued by the provider.
• Do not participate while impaired by alcohol, illegal drugs or any condition that makes participation unsafe.
• Disclose information specifically requested by the provider where reasonably necessary for safety or eligibility.
• Do not misuse the platform, make fraudulent bookings, interfere with other users, or submit unlawful, abusive or misleading content.

If GoRush enables reviews or uploads, you remain responsible for your content and grant GoRush a non-exclusive licence to display and use it for operating and promoting the platform. Content must be lawful, relevant and not infringe third-party rights. GoRush may moderate or remove content where reasonably necessary.

Personal data is processed as described in the GoRush Privacy Policy. Booking information may be shared with the relevant provider and payment information with the applicable payment processor to the extent necessary to complete the transaction and provide the service.

The GoRush platform, brand, software, layout and platform-created content are owned by or licensed to GoRush. Provider names, logos, photographs and listing content remain owned by their respective owners or licensors. You may use the platform only for personal, lawful booking purposes unless GoRush gives written permission otherwise.

To the maximum extent permitted by applicable law, each party is responsible for loss caused by its own breach, negligence, misconduct or legal responsibility. GoRush is not the operator of an independent provider’s activity merely because the service is listed or booked through the platform. GoRush does not exclude liability that cannot legally be excluded, and these Terms do not limit mandatory UAE consumer rights.

GoRush will not be liable for indirect or consequential loss that was not reasonably foreseeable at the time of contracting, except where such exclusion is prohibited by law.

GoRush may restrict or suspend access where reasonably necessary for security, fraud prevention, legal compliance, material breach or protection of customers/providers. A user may stop using the platform at any time, subject to outstanding bookings, payments, refunds or disputes.

You agree that contracts, notices, confirmations and records may be created, accepted, sent and stored electronically. Clicking an acceptance or booking button, completing registration or otherwise taking an electronic action clearly presented as acceptance may constitute your electronic acceptance to the extent permitted by UAE law.

These Terms are governed by the applicable federal laws of the United Arab Emirates and the laws and regulations applicable in the Emirate of Dubai. Subject to mandatory consumer rights and any competent authority’s jurisdiction, disputes shall be submitted to the competent courts of Dubai, UAE.

We may update these Terms for legal, operational or product reasons. Material changes affecting existing users will be communicated where reasonably required. Changes will not retroactively remove rights already accrued in relation to a confirmed booking unless required by law.
